These Terms of Use ("Terms") govern your access to and use of the TrackingJobs website and email newsletter. By using the site or subscribing to the newsletter, you agree to these Terms and to our Privacy notice.

1. Who we are

TrackingJobs is operated by Trackingplan Inc., a company incorporated in the United States (Delaware), with registered office at 2093 Philadelphia Pike #1638, Claymont, Delaware 2093, United States ("Trackingplan", "we", "us"). We offer the service to individuals in the European Economic Area, the United Kingdom, Switzerland, the United States and elsewhere.

2. The service

TrackingJobs is a free email newsletter that surfaces curated job listings. We do not guarantee any particular uptime, sending schedule, volume of listings, or that listings will be complete, current or accurate. Job content originates from third-party sources; we do not employ you or guarantee that any role remains open.

3. Newsletter subscription

To subscribe you provide at minimum an email address and your content preferences (for example roles and countries). We use a double opt-in flow where applicable. By subscribing you confirm that the address is yours and that you agree to receive messages described at signup.

Every email includes instructions to unsubscribe. You may also contact us at hello@trackingjobs.com to stop processing. How we handle personal data—including hosting in the EU for our database and delivery through our email provider—is described in our Privacy notice.

4. Eligibility

You must be old enough to consent to data processing in your country (often at least 16, or the age your local law requires). If you use the service on behalf of an organization, you confirm you are authorized to bind that organization.

Our Privacy notice explains what we collect (including email and subscription preferences), legal bases, retention, your rights under applicable privacy laws, and the subprocessors we rely on—such as hosting, database (including EU-region storage), and email delivery. Those providers process data on our instructions under appropriate contracts and safeguards where data moves outside the European Economic Area.

We do not sell your personal data. We do not use analytics trackers on this site for behavioral profiling as described in our Privacy notice; newsletter delivery does not use open or click tracking beyond what is stated there.

7. Intellectual property

Job listings and employer branding remain the property of their respective owners. The TrackingJobs name, logo, selection and editorial framing are © Trackingplan Inc. and the TrackingJobs team. You may not reuse our branding or substantial excerpts without permission except as allowed by law.

8. Third-party content and links

The site may link to third-party careers pages or sources. We are not responsible for third-party terms, accuracy of postings, or hiring outcomes. Your relationship with an employer is solely between you and them.

9. Disclaimer of warranties

The service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, or non-infringement, to the fullest extent permitted by law.

10. Limitation of liability

To the fullest extent permitted by applicable law, Trackingplan Inc. and its team will not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits, data, goodwill or opportunities, arising from your use of the newsletter or site, third-party job listings, or hiring decisions you make based on information we send.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under mandatory law (including consumer rights where you qualify as a consumer in the EU, UK or elsewhere).

11. Governing law and disputes

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-law rules that would apply another jurisdiction's laws.

If you are a consumer resident in the European Union, United Kingdom or another jurisdiction that grants you mandatory protections, those protections remain available to you regardless of this choice of law. Courts in your country of residence may have jurisdiction over disputes concerning consumer rights where applicable law requires it.

12. Changes

We may update these Terms from time to time. We will revise the "Last updated" date above. If changes are material we will provide reasonable notice (for example by email to subscribers or a notice on the site). Continued use of the site or subscription after changes take effect constitutes acceptance of the updated Terms.
